Joyce Goldstein, a Labor and Employee Benefits Lawyer at Joyce Goldstein & Associates, joined the America’s Work Force Union Podcast to discuss the process to file a labor dispute claim with the National Labor Relations Board (NLRB).
The National Labor Relations Act provides employees the right to engage in protected concerted activity. Any employer who interferes with a worker’s right to organize commits an unfair labor practice, Goldstein said.
Violations can include firing an employee due to union activity, spying on employees in order to discourage organizing and other acts of interference, she added.
Goldstein urged employees who believe they were the victim of a violation to file a claim on the NLRB’s website. She urged workers to act fast, as violations have a six-month statute of limitations.
She also urged listeners to be patient with the process, as it can take years. She described the steps in detail and pointed out companies will often file appeals in order to slow down the process even further.
