Andrew Strom, a labor lawyer and contributor to the OnLabor Blog, joined the America’s Work Force Union Podcast to discuss the potential impacts the presidential election results could have on the National Labor Relation Board (NLRB). He also discussed holes in the National Labor Relation Act that have been exploited by corporations.
Strom started by discussing how the past eight years could provide a small look at the next four years under the new Trump Administration. He compared how the first term under President Trump compared to the Biden Administration in terms of labor law in America. He provided several examples of workers having better protections under the Biden Administration than they did under the first Trump Administration.
Among the concerns Strom raised is protecting American’s right to organize their workplace and potential termination of the NLRB board members and Administrative Law Judges. He talked about the way the current NLRB has handled different Unfair Labor Practices filings, and how these differed from the NLRB under the Trump Administration. Strom also talked about the potential impact the transition could have on sitting Board Members and Administrative Law Judges.
Finally, Strom discussed the holes in the National Labor Relations Act that allow corporations to seek review in any circuit court where they do business. He discussed how the companies are choosing to “shop” for a more “business-friendly” circuit ro review any case against them. Strom said this is not something new, but many of the recent cases have set a precedent that this happens for every case involving businesses with a national market.
